Introduction
Our international F.I.T. and escorted group tours are sold under the brand “Gainwell Leisure Holidays” All our products are sold subject to these Terms and Conditions and the contract between you and us shall be governed by the same.
If you book any third party products through us, their Terms and Conditions would be applicable in addition to our Terms and Conditions

Eligibility
Indian nationals eligible to travel on our tours must have a valid passport for at least six months subsequent to the date of departure of the tour,valid for not more than 10 years and have been granted the necessary visas, international certificates of vaccination, insurance and medical insurance, other travel documents and clearances required to travel throughout the tour. You will have to abide with applicable RBI guidelines and Government of India rules.

Contract
  • Please complete and sign the Booking Form and the Terms and Conditions Form per party after perusing the How to Book rules, Terms and Conditions, tour brochure, itinerary or website.
  • In cases where tour participants belong to more than one family under a single form, it shall be signed by the head / authorized person of each family and the same shall be construed as acceptance of a contract for and on behalf of all persons booked.
  • In case the travel agent or any other person signs the Booking Form, it shall be conclusively presumed that the tour participants had given the necessary authority to such lead person / agent to sign the Booking Form and Terms and Conditions form and enter into a binding contract on their behalf with the company.
  • If you are booking through your Travel Agent, you should make all payments to your travel agent and the travel agent would pay the Company on your behalf.
  • Signing of the Booking Form and Terms and Conditions form and payment receipt issued for initial payment made towards the tour cost shall be a legally binding contract between the parties.

  • Complete details of the Tour Arrangement/Itinery/Package Cost and Terms & conditions of the tour have been provided to you. You are requested to read the same carefully before filling up and signing the Terms & Conditions of the tour. The Terms & Conditions, Booking Form, Payment Receipt shall be binding on the parties & shall constitute a contract between the parties. In case of one or more but not all the Clients signing the Booking Form/Terms & Conditions, it shall be deemed that the others have duly authorized the concerned signing the Client/s to do so. The signing of the Booking Form & Terms & Conditions of the Client or by you shall reconfirm the acceptance of the Terms & Conditions contained herein by the Clients/s in totality.
                  
  • The Company reserves the right to decline to book any person/s for any Tour or to cancel their                
    booking without assigning any reason.

    No person including the Employee/s the Company or yourself have the authority to alter, amend or waive
    any stipulation, representation, Terms or Condition set forth in this document. Assurance if any, which is
    contrary to the terms & conditions given shall not bind the Company.
  • The prices are on per person basis. These rates are valid for a minimum of 2 people traveling together.
 
  • Tour Price are subject to change due to increase/introduction of new tax or any surcharge imposed by suppliers/airlines. In case of passenger traveling on different date from the groups travel, passenger has to bear a deviation charge alongwith applicable fare differences on the class of booking.
  • Tour itinerary will be strictly followed as mentioned in the brochure. There will not be any refund against any non utilized services by the passenger on his own. If the passenger do not report as per schedule, they have to make own arrangements at own cost to meet the group
 
  • Price indicated is valid for a maximum of 7 days from offer date. We reserve the right to amend or remove this offer at any time. THE RATES ARE NOT VALID OVER PEAK SEASON TRAVEL
  • It is imperative that a passenger has read and understood the itinerary, cost implication, payment schedule and terms & conditions of the Company before signing the Tour Registration Forms/ paying booking amount towards part consideration of the tour cost.
 
  • It would not be possible to provide special meal or special diet other than what is mentioned in the brochure. Expenses for special meal/diet are to borne by the passenger and no refund would be made against non utilized meal.
  • Passengers are advised to keep their baggages (including valuables), travel documents i.e Passport, Airtickets, Foreign Exchange in the safe custody. In the case of loss, expenses in regard to obtaining duplicate travel  documents will have to be borne by the passenger. Under no circumstances Company can be held responsible for any such losses caused during the tour.
 
  • It is the responsibility of the passenger to have valid documents like Passport which should be valid for 6 months from date of travel, Visa, Health insurance, vaccination. etc. In case  Gainwell is applying visa on behalf of the passenger, then it is the responsibility of the passenger to provide all documents required by authority. Visas / European visas may take 6 - 10 weeks to process & solely at the discretion of the Consulate. However, Gainwell will not be responsible for refusal/ delay of visa as they are only working as facilitator or service provider.
  • Passenger must have adequate insurance cover to secure their life, health & belongings. It is made abundantly clear that Gainwell is no way liable to the passenger or to any other person for personal death, injury, accident, delay & discomfort. It is the duty of the passenger or their next to keen to inform the medical condition that may effect his  full participation in tour arrangements and the interest of the group or any member  thereof is prejudicially affected. Company has full authority to ask any passenger to submit  medical certificate before departure.
 
  • Gainwell can not be held responsible for  circumstances beyond control and arising out of natural calamities, delays, strikes, breakdown in facilities, accidents etc. However caused (Force Majeure vis Majeure)
  • Disputes, if any are to be settled under the exclusive jurisdiction of the Courts of Kolkata only.
 
  • All tours are subject to R.B.I/ G.O.I rules and for BTQ passengers only.
All payments made within  7 days prior to the group departure date will have to be settled either in Cash/bankers cheque. The PAN card copy will be required when payments amounting Rs.50000/- or above are made by cash.
TIPS FOR TRAVELLING

Your Personal Tour Expenses
You need to carry money for your shopping and personal expenses like tips, mineral water (although tap water is safe for drinking), a la carte meals, alcoholic beverages, tea / coffee, soft drinks, telephone calls, laundry, mini-bars, pay channels on T.V., paid toilets, porterage, room service, excess baggage charge, etc. as they are not included unless specifically mentioned as included in the Brochure or Price Grid.

Punctuality
The drivers are bound by restrictions concerning maximum driving hours per day and per week, and the itineraries are planned with regard to the same. It is therefore essential that the itineraries, schedules and timings are strictly adhered to by you so as to ensure that all the services can be duly provided. If you or any of your co-passengers miss any service due to unpunctuality, there would be no refund for the same. This shall be applicable even on occasion when you are affected by your co-passenger's lack of punctuality.

Things To Carry On Tour
In general, carry 4 to 5 pairs of casual clothing like jeans, trousers, shorts, T-shirts, shirts, dresses, sarees, swimwear, comfortable walking shoes and a formal attire for occasions like a Gala Evening Dinner. In Europe, Australia and New Zealand you will need to additionally carry thermal wear / warm clothing like woolen sweaters / pullovers, shawls, warm socks, warm jacket, stockings, gloves and a wind cheater.

Baggage Information
Please travel light as porters are not always available. Bags with wheels are advised as you need to carry your bags at the airports, from /to the coach, hotels, etc. Never accept any parcel / bags from any strangers / co-passengers. Be alert while loading / unloading your luggage lest you be robbed.

We recommend an overnight bag with the bare essentials for the overnight stays in some hotels.

Airline Baggage Allowance
Economy class passengers may carry upto 20 kgs of check-in baggage per person and one piece of hand luggage not more than 5 kgs. Excess baggage payment varies on low cost airlines and is 1.5% of normal IATA fare on other airlines. Please note that, airline / baggage policies are revised from time to time. Please check with the concerned airline. Airline rules regarding baggage keep changing. All your baggage will be screened and possibly hand-searched as part of the security measures.

Travellers may carry limited quantities of liquids, gels or pastes in containers not exceeding 3 oz or 90 ml. The containers must be carried in a separate clear plastic, zip-top or re-sealable bag that does not exceed 20cm x 20cm. At the airport, the plastic bag must be removed from the cabin bag and be x-rayed separately

Hand Baggage / Essential / Personal Items
Your hand baggage should include toiletries, sun glasses, extra set of prescription glasses, torch, umbrella, sweater / shawl, camera / video (batteries to be removed and kept in the check-in baggage), film rolls or video cassettes, universal electric plug pin, international roaming cellular phone, SIM card and charger if necessary and a set of clothes. Valuables should not be put in the check-in baggage and should be kept in hand baggage only, along with medicines with doctor's prescriptions. Medicines need prescriptions, with a drug generic name listed, as the brand name differs across countries.

Travel Documents
You should carry your Gainwell service vouchers, hotel contact list, airline tickets, your passport, passport-sized photographs, overseas travel insurance policy, emergency contact numbers, travellers cheques / foreign exchange pre-paid card etc. with you. Please carry a photocopy of all the documents listed above including valid visa pages, which are to be kept separately from the original.

If you are carrying Travellers Cheques, please keep the purchase receipt in a safe place, away from the original Travellers Cheques. Your passport is required as identification to encash your travellers cheques. Most credit cards and US Dollar travellers cheques are widely accepted.
Amendments

Transfer from one tour to another will be treated as cancellation from one tour and fresh booking on another. Therefore normal cancellation charges will be applicable. In case passenger wishes either to prepone/postpone his date of journey apart from the scheduled group departure dates, airlines levies a deviation charge which will be intimated to the passenger and the passenger has to bear the same. In case on the changed date seats are not available on the desired class of booking, passenger needs to pay the differential amount for the difference in class of booking. All amendments will attract an amendment fee of Rs.1000 per change.
CANCELLATIONS

We book the services in advance and bound to honor the commitments as to payment to suppliers, cancellation of services results in Company losing money depending upon the time of communication to the supplier and therefore, the cancellation schedule, which is based on the above amongst other factors becomes applicable on cancellation. The cancellation must be intimated to us in writing. As per the booking conditions of the Tour we are constrained to levy the following

charges. Rs 5000/- : Non Refundable booking deposit
25% of the total tour cost :60-31 days prior departure
50% of the total tour cost :- 30-15 days prior departure
No Refund 14 days prior departure
Visa fees and Service charge are non- refundable.
REFUNDS

Refunds (if any) for amendments/or cancellations will be paid by the Company which would take at least 30 days to process refunds. Any refunds, whether payment received in INR or foreign exchange will be settled in INR only at the prevailing Foreign Exchange buying rate. There is no refund payable for any unutilized services( e.g. Meals, Entrance Fees, Hotels. Cruise etc)
